                    <dim:field mdschema="dc" element="description" qualifier="abstract">If after the contract has been concluded such circumstances emerge which hinder the performance of obligation of one party, or make realisation of the contract’s purpose impossibile, the unable party has the right to request the repudiation of that contract, under certain circumstances prescribed by law and in order to protect the principle of equal consideration. The rules of repudiation or alteration of contract due to changed circumstances (hardship), which originate from the canon law, had been further developed through legislation and case law of different European countries after the First World War and the Second World War. Today, there are different approaches when it comes to this particular legal institute. Republic of Serbia’s law of contracts, like its German role-model, accepts the rules of repudiation or alteration due to hardship if certain legal prerequisits exist. As for the international conventions, there has been a trend of accepting the above mentioned rules. Therefore, in this paper we made a short overview of the manner in which rules of repudiation or alteration due to hardship are being regulated in different international legal documents, with special reference to some specific soultions which in our opinion should be incorporated in Serbian legal system.</dim:field>
